By accessing our website at mepost.io or using our services, including but not limited to email sending, IP and domain management, and analytics services ("Services"), you agree to be bound by these Terms of Service ("Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

2. Service Description

Mepost provides a comprehensive set of tools for managing email campaigns, including an API for sending emails, managing IPs and domains, and a single-page application for analyzing metrics such as email reads, clicks, and more. Additionally, Mepost offers a Docusaurus-powered webpage for promotion, SEO, blogs, pricing information, and documentation.

3. User Obligations

You agree to (a) provide accurate, current, and complete information about you as may be prompted by any registration forms on the Site ("Registration Data"); (b) maintain the security of your password and identification; (c) maintain and promptly update the Registration Data, and any other information you provide to the Company, to keep it accurate, current, and complete; and (d) accept all risks of unauthorized access to the Registration Data and any other information you provide to the Company.

4. Intellectual Property Rights

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Mepost and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

5. User Conduct

You are solely responsible for your conduct and your data related to the Service. You agree to use the Service in compliance with all applicable laws, rules, and regulations, including but not limited to those related to spam and electronic communications. Specifically, you agree not to:

  • Use the Service to send unsolicited email messages or spam.
  • Send emails through the Service in violation of the CAN-SPAM Act or any other applicable anti-spam laws.
  • Use the Service to harass, abuse, or harm another person or entity.
  • Impersonate another user or provide misleading information about your identity.
  • Engage in any activity that interferes with or disrupts the Service or servers or networks connected to the Service.

Violation of any of these agreements will result in the immediate termination of your account and may subject you to civil and criminal penalties.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Specifically, if your use of the Service involves the sending of spam or unsolicited email messages, your account may be terminated immediately.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Limitation of Liability

In no event shall Mepost, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
